R E S O L U T I O N WHEREAS, TAYLOR LAKE HOME OWNERS’ ASSOCIATION was incorporated under the provisions of Act 137, Public Acts of Michigan for the year 1929, as amended, on AUGUST 29, 1972 as a body politic and corporate, and has functioned continuously since such date as a body politic and corporate for a period of more than two years, and WHEREAS, said Act 137, Public Acts of Michigan for the year 1929, as amended, authorizes, after the expiration of such two years, the calling of an election within the territory comprising the subdivisions or parts of subdivisions affected to determine whether the entire territory should become incorporated under the provisions of said act, NOW THEREFORE BE IT RESOLVED that it is the judgement of the Board of Trustees of TAYLOR LAKE HOMEOWNERS’ ASSOCIATION that the following described lands situated in the Township of Rose, Oakland County, Michigan, viz: All lots (except Lot 28) in McClatchey’s Taylor Lake Heights, a subdivision of part of the Southwest ¼ of Section 8, Town 4 North, Range 7 East, Rose Township, Oakland County, Michigan. All lots in SUPERVISOR’S PLAT NO. 6, being the Southeast ¼ of the Southwest ¼ of Section 8, Town 4 North, Range 7 East, Rose Township, Oakland County, Michigan. All lands in the North ½ of the Southwest ¼ of Section 8, Town 4 North, Range 7 East, Rose Township, Oakland County, Michigan. are sufficiently identified with the common interests of the lands now embraced within the jurisdiction of the TAYLOR LAKE HOMEOWNERS’ ASSOCIATION as to make the owners of said lands eligible as proposed members of said corporation; and BE IT FURTHER RESOLVED that the Board of Trustees of TAYLOR LAKE HOMEOWNERS’ ASSOCIATION call, and it does hereby call, an election under the provisions of Act 137, Public Acts of Michigan for the year 1929, as amended, to determine whether all the above described territory shall become entirely incorporated under the provisions of said Act, notice of such election to be given and such election to be held on the 2nd day of September, 1972, during the hours prescribed in such notice; and BE IT FURTHER RESOLVED that a notice in words and figures as follows: Legal Notice of Association Incorporation Election Registration Card for Association Incorporation Election and to keep such registrations in a book provided for that purpose and to deliver said registrations to the election board hereinafter named on the 2nd day of September, 1972, prior to 7:00 o’clock A.M. BE IT FUTRHER RESOLVED that Robert J. Klug, Fred Wehrmeister, Bernard Jurosek, John Vivian, and Francis C. Trimmer be and they are hereby appointed as a 5-man election board to conduct such election in accordance with the provisions of Act 137, Public Acts of Michigan for 1929, as amended, and in accordance with the general election rules in the State of Michigan, on the 2nd day of September, 1972, between the hours of 7:00 o’clock A.M. and 8:00 o’clock P.M., at the place designated in the above notice of election; to count the ballots cast in such election; to certify the results of such count to the Board of Trustees of TAYLOR LAKE HOMEOWNERS’ ASSOCATION at its next regular meeting or a special meeting called for that purpose, and to the Board of Canvassers hereinafter named; to seal up and deliver the ballots cast in said election, after they are counted, to said Board of Trustees; and to deliver to said Board of Trustees the registration book and/or other records use in said election to be safely kept by said Board or Trustees for a period of at least one year following such election. That the form of report of the results of said election to be submitted by the election board to the Board of Trustees and Board of Canvassers shall be as follows: TO THE BOARD OF TRUSTEES AND BOARD OF CANVASSERS, TAYLOR LAKE HOMEOWNERS’ ASSOCIATION: We, Robert J. Klug, Fred Wehrmeister, Bernard Jurosek, John Vivian, and Francis C. Trimmer, the election board heretofore appointed by the Board of Trustees of TAYLOR LAKE HOMEOWNERS’ ASSOCATION to conduct an election on September 2, 1972, to determine whether all the lands described in the notice of such election shall become entirely incorporated under the provisions of Act 137, Public Acts of Michigan for 1929, as amended, do hereby certify and return that we have conducted such election at the time and place specified in such notice, have counted the ballots cast by qualified voters in such election, and that the results of such election are as follows: (A) Total number of registered voters. (B) Total number of votes cast. (C) Total number of votes cast in favor of entire incorporation of said territory. (D) Total number of votes cast against entire incorporation of said territory. (E) Total number of spoiled ballots. [Dated and Signed by the Election Board] BE IT FURTHER RESOLVED that Tom Tarby, Bob Schuster, Curtis Bell, and Clara Smoot be and they are hereby appointed as a 4-man Board of Canvassers to receive the report of the election board herein named, after such election has been held, and within five days after such election to canvass and certify the results thereof to the Board of Trustees, such report of the Board of Canvassers to be in the following form: TO THE BOARD OF TRUSTEES, TAYLOR LAKE HOMEOWNERS’ ASSOCIATION: We, Tom Tarby, Bob Schuster, Curtis Bell, and Clara Smoot, the Board of Canvassers heretofore appointed by the Board of Trustees of TAYLOR LAKE HOMEOWNERS’ ASSOCIATION to canvass and certify the results of the election on September 2, 1972 to determine whether all of the land described in the notice of such election shall become entirely incorporated under the provisions of Act 137, Public Acts of Michigan for 1929, as amended, do hereby certify that, in accordance with the report of the election board appointed to conduct such election and report the results thereof, the majority of the qualified voters voting in such election voted In favor of (strike out one) Against entire incorporation of the territory described in the notice of said election under the provisions of Act 137, Public Acts of Michigan for 1929, as amended. [Signatures of the Board of Canvassers] BE IT FURTHER RESOLVED that the form of ballot to be used in such election shall be as follows: Ballot for Association Incorporation Election BE IT FURTHER RESOLVED that the election board hereinbefore appointed be and it hereby is authorized to deliver to any qualified registered voter making application therefor in writing prior to the date of said election certifying that he will be absent from the County of Oakland on the date of said election, an absentee ballot in the form above prescribed, together with an envelope addressed to a member of said election board plainly marked on the outside thereof "ABSENTEE BALLOT", an that any such absentee ballot properly marked and returned in person or by mail to said election board before the close of the polls on said election day shall be counted in said election. |
